In a crucial development, former Attorney General of India (AGI) Mukul Rohatgi will appear for Aryan Khan’s bail plea today before the Bombay High Court.

Rohatgi — who recently slammed the Narcotics Control Bureau by terming it as “an Ostrich with head buried in the sand”, will join Khan’s existing battery of lawyers in the HC during the day.

Besides Rohatgi, Khan’s side comprises senior lawyers like Amit Desai and Satish Maneshinde who have fought for him in the Magistrate Court and Special NDPS Court, besides the HC.

What’s the case?

Aryan Khan, 24, and 7 others were detained on October 2 after the NCB raided a rave party aboard a cruise ship, and the following day arrested, with another 12 subsequent arrests made in the sensational case.

The HC will hear the bail pleas of Khan, Arbaaz Merchant, and Munmun Dhamecha, all of whom have so far spent 25 nights away from home.

The drugs case has also ignited a political row with the Maharashtra government accusing the NCB of going after specific individuals on orders from the Centre.

Rohatgi is the son of former Delhi High Court judge Justice Awadh Behari Rohatgi. He has represented the Government of Gujarat in the Supreme Court in the 2002 Gujarat riots and allegedly fake encounter death cases, including the Best Bakery and Zahira Sheikh cases.

Aryan Khan and others accused in the case have been booked for offences under Sections 8(c), 20(b), 27, 28, 29 and 35 of the NDPS Act.

So far, 20 people have been arrested in the case.

Rohatgi was the 14th Attorney-General of India and was succeeded by K.K Venugopal. The 66-year-old is a senior advocate at the Supreme Court of India and has earlier served as Additional Solicitor General of India. The lawyer held the office of AGI for three years starting from 2014 to 2017.

The 66-year-old senior advocate has represented several famous and critical cases in the court, including the 2002 Gujarat riots case where he appeared before the court for the government of Gujarat. The case relating to the National Judicial Appointment Commission is also a landmark judgement argued by Rohatgi in his capacity as ASG.

He was appointed Special Prosecutor and received a fee of Rs. 1.20 crore from the government of Maharashtra in the high-profile case probing the death of CBI Special Judge BH Loya. In April 2018, the Supreme Court had quashed the plea demanding a probe into his death, and Rohatgi had hailed the apex court’s decision.

A friend of late Arun Jaitley, the former finance and law minister in Narendra Modi’s first tenure, Rohatgi has often spoken fondly about his relationship with the former. The two lawyers, part of a circle of friends doing the rounds of Lodi Garden in the morning, would often put aside their professional differences to engage in chai and chit-chat.

“Our chambers in the high court used to be next to each other. We still have those chambers. In court, we used to oppose each other very often. In heat of the moment, we used to use harsh words but later sit as friends,” Rohatgi, paying tribute to Jaitley, was quoted as saying in August 2019 when he passed away.

Rohatgi followed in the footsteps of his famous father – Awadh Behari Rohatgi – who was a judge in the Delhi High Court. He completed law from Government Law College in Mumbai and started practicing straight after college. Initially, he worked under Yogesh Kumar Sabharwal, who later became the 36th Chief Justice of India, in the Delhi High Court.

The senior advocate then started his own legal practice. In 1993, Rohatgi was designated as a senior counsel by the Delhi HC and was later appointed as Additional Solicitor General of India in 1999.

Mukul Rohatgi Education

Mukul Rohatgi obtained his Bachelor of Law degree from the prestigious Government Law College in Mumbai.

From his childhood, he was keen to take up law as a profession because his father, Justice Awadh Behari Rohatgi, was a member of the judiciary and retired as a judge of the Delhi High Court.
